DISPUTES LAWYER

Tony Pearce
On leaving a Comprehensive school aged 15 I attended an Armed Forces College. After service in Commando Forces, I worked as a diver, outward bound instructor and in sales for a “Blue Chip” company before embarking upon a legal career.
In 1990 I was admitted as a Solicitor and Officer of the High Court of England and Wales. I later qualified for admission as a solicitor and barrister through Auckland University but did not seek admission in New Zealand having decided to concentrate on a legal career in England and Wales. My interest in New Zealand law has however remained strong. In 2020 I was appointed to the Law Association of New Zealand Trust Law Committee. I was re-appointed in 2024 as special advisor to the Committee. I live in England so attending lunchtime Committee meetings in Auckland does present a challenge despite the technological advances we have all become familiar with.
I have judicial experience having sat as a Deputy District Judge (Civil) in South West England. I am a full member of the Association of Contentious Trust and Probate Specialists (www.actaps.com), a member of the Contentious Trust Association (“ConTrA) and an affiliate member of the Society of Trust and Estate Practitioners (www.step.org).
I assist individuals and groups. For example Executors, Administrators, Beneficiaries under a Will or Trust, Trustees, Trust Property owners or those claiming against Trust Property, who requiring advice or assistance negotiate and resolve disputes. Disputes may often involve allegations of fraud, misuse of estate and/or trust funds and dissipation of assets. My approach to dispute resolution is straightforward and simplistic – what is in the best interest of my client(s)? I will strongly advocate Alternative Dispute Resolution. Very few people choose to “go to court” given the risks, cost and emotions that often feature. Despite outright objection or resistance by some, avoiding a court imposed solution is very often the best approach for all sides. Sadly, on occasions it proves impossible to avoid court litigation. If that proves to be the case you need a lawyer with knowledge and experience to fight your corner.
I have advised clients in New Zealand, Australia, France, Spain, the United Arab Emirates, the USA, Canada and South Africa as often Trust and Estate disputes cross borders. I work alongside colleagues based in many jurisdictions including BVI, Europe, Asia and the USA.
I have served on the boards of trustees of charities including a leading research and medical charity. I have studied Japanese culture and history for a number of years and have a strong interest in the writings and discoveries of Captain James Cook (1728 – 1779). My wife and I have travelled extensively, and our adventures continue.
